Terms of Service 2024

By commissioning the Artist, you automatically agree to the terms listed below. These terms are subject to change at any time. Please read through the whole ToS before placing a commission.

Payment
  • Payment is only through PayPal in USD.

  • As soon as the Artist messages the Client confirming the order, the Client has 48 hours to respond. If the Client does not respond within those 48 hours, the commission is immediately forfeited and will not be looked at again unless commissioned at a later date.

  • The Artist will send the Client an invoice on confirmation of a commission. This begins the contract between Artist and Client.

  • Invoice must be paid within 72 hours, unless otherwise stated, or the commission is forfeit.

  • Commissions $100 or under must be paid upfront.

  • Commissions over $100 are eligible for a payment plan.

  • Options for payment plans are as follows:

    • Plan 1: 50%/50%

    • Plan 2: 50%/25%/25% 

    • Plan 3: 25%/25%/50%

Subject Matter
  • The Artist will draw all species (real or fantasy), humans/humanoids, body types, sexual orientations, gender identities, and Artistic nudity.

  • The Artist will draw all characters (originally created or fandom-created).

  • Violence, Gore, and suggestive commissions are accepted under the Artist's discretion.

  • The Artist will not draw sexually explicit commissions, anything relating to politics (representation of sexual orientations and gender identities do NOT fall into this), and anything offensive (racism, homophobia, transphobia, incest, pedophilia etc.)

Overview & Ownership
  • The Artist has the right to refuse a commission for any reason.

  • The Artist has the right to cancel a commission at any time. If payment was sent, a full or partial refund will be issued depending on completion level of the commission.

  • The Artist retains the right to display any and all commissioned work unless otherwise discussed (permission to display commissioned work will be asked before progress has been started and/or after completion of the commission.)

  • The Artist may recycle sketches and preparatory works that were rejected by the Client for other commissions or personal works.

  • The Client retains all rights to any depicted characters they own.

  • The Client may use the commission for personal usage, such as follows: 

    • Uploading the watermarked artwork to their personal website and/or gallery (accompanied by a credit line to the Artist). 

    • Cropping the artwork for: avatars, wallpapers, icons, and/or profile pictures. 

    • Using the artwork for fanfiction/original fiction cover art. 

    • Printing the artwork for personal display.

  • The Client DOES NOT have the right to:

    • Upload an unwatermarked version and claim it as the Clients own.

    • Alter the artwork in any way, shape, or form and claim it as the Clients own.

    • To resell or redistribute the illustration in any way, unless otherwise stated.

    • To use any AI Image Generation to edit the artwork.

    • To tokenize the commissioned artwork (i.e. NFTs and other forms of crypto currency.)

Completion Time & Extra Charges
  • Small Commissions: Completion time of 1-5 days on average.

  • Medium Commissions: Completion time of 1-4 weeks on average.

  • Large Commissions: Competition time of 1-3 months on average.

  • All average completion times may vary depending on commission size, complexity, and communication.

  • The Client may request a specific deadline but will be subject to an additional Rush-Job fee.

  • The Artist may apply extra charges of up to $50/hr due to complexity, size, and difficulty of the commission. Reasons for extra charges include but are not limited to: Extremely detailed characters (markings, hairstyles, extra limbs, etc.), Machine/Robotic parts, Complex costuming (armor, etc.), extremely detailed backgrounds or high-difficulty compositions

Process & Edits
  • The Artist will send out WIPs of the rough sketch, line art stages, and color stages of the commission unless otherwise specified. 

    • Icon and Headshot commissions will NOT have WIPs sent to the Client.

    • Major pose fixes/alterations may be requested during the rough sketch stage only.

  • Up to 3 alterations per showcase are allowed to be made upon the Client’s request once seeing a WIP.

    • Ex: The Artist will send the first WIP of the rough sketch. The Client asks for a minor rework. The Artist does the rework and shows the edited WIP. The Client may ask for 2 more minor edits after the fact. Once the third and final rework has been completed, the Client may not ask for more on that specific WIP. The process may be repeated with the next 2 WIP showcases.

  • The Client may request up to one commission change before the thumbnail/rough sketch stage.

  • The Artist will not provide a full resolution file or finished preview unless full payment is received.

  • The Artist allows for minor edits to a finished commission. Moderate to major edits will be subject to accrue additional fees of $50/hr.

Character Design Policy
  • The Client must have either a mood board or a written description for the Client’s desired character design before any work may begin. If the Client refuses to comply the Artist has the right to refuse the commission.

  • The Client gains all rights to the character of any design commissioned (or adopted) from the Artist.

  • The Artist retains all rights to the original artwork created.

  • The Client may NOT purchase character designs or adoptables from the Artist with the intentions of reselling them. Upon discovery of this intention, the Client immediately forfeits all rights to the character back to the Artist. The Client is solely responsible for refunding the party affected by the forfeit of the character. The Client will also be banned from commissioning the Artist afterwards.

  • The Client may rehome the character after 30 days minimum of ownership. Should the Client choose to rehome the character they may resell. The Client may NOT rehome the design for more than what it was purchased for. 

Refund Policy
  • The Client may cancel the commission and request a full refund before work begins. 

  • Once the thumbnail/sketch phase has been approved, the client may request a refund, but it will only be half of what the Client paid.

    • Ex: If the Client paid $100 for a Halfbody commission, but requests a refund halfway through the process, the Client will only be refunded $50.

  • If the Client requests a refund at the end of the commission, the Client will either NOT be refunded or only refunded 25% of the original payment, depending on how close to completion the commission is.

  • In the event of Client cancellation of a commission with a payment plan, all work and invoices will be halted.
